One of the things I think is absolutely necessary is for Congress to make immigration courts Article 3 courts. It clearly has the power to do so. This is particularly important if the Extremes keep pushing the "unitary executive" theory. The immigration courts are supposed to make decisions based on evidence; far too often they are just deciding based on what their Bosses at DHS tell them to do. Congress should also make sure that those who are coming for regularly scheduled check ins on pending cases are IMMUNE from ICE dragnets. The courts would KNOW if they had issued a deportation order.

This is such a great solution to the "immigration problem." I wholeheartedly agree that it is the patriotic fulfillment of the American dream. It benefits all of us.

In this scenario, is there still such a thing as illegal immigration, or does it come with open borders?

I'd prefer a much easier path to entry focused on welcoming people in rather than trying to keep them out. Not sure if that counts as open borders, but the best way to reduce undocumented people is just to make it a lot easier to get in, as was long the case in the past.

It isn't so much immigrants as it is the American addiction to law-and-order that goes at least back to the Wild West. Richard Slotkin's book "Gunfighter Nation" shows exactly to what extent this virus infiltrated popular culture, and, from there, politics.
