I agree, but in some cases, I think Congress is going to have to take an additional step. To counter the unitary executive movement, Congress needs to take power away from the President. For starters, I would establish the Office of Inspectors General as reporting to the Speaker of the House. Congress has oversight authority, so Inspectors General should report to Congress and the President shouldn’t be able to fire them. And as part of the legislation to establish this, Congress should tell the Supreme Court to “go pound sand” with respect to court review.
This! Also, Congress has the constitutional power to place restrictions on the Court, and should do so. At the very least, legislate limits on the shadow docket!
I’m happy that people are beginning to think about what comes next. What can’t happen is a return to the status quo, and fighting that retrograde impulse will be the next big battle after defeating the christo-fascists. Expanding the court will be key. Up until a century ago, Congress added SCOTUS seats when they added federal circuits. We should have 13 members of SCOTUS by that standard. (Don’t tell Trump!)
Of course we’ll also need term limits and enforceable ethics rules. And while we’re at it, we should expand Congress to reduce district sizes to more representative levels (and make gerrymandering more difficult). We stopped expanding Congress a century ago as well.
