No need to arrest Justices. Just announce that in the interest of national security, the FBI will monitor and record all communications involving a Justice of the Supreme Court. Phone calls, texts, emails, and anything encrypted that the NSA can decrypt. You can never be too careful. Clearly this would be an official act of the President.

Actually, they declared that they alone can decide what an official act is. Roberts’ opinion sets it up so that only the SC can decide. Lower court judges will call it as best they can, but any decision will be moved back up the appeals process for the SC to decide. They made themselves kings.

They wouldn’t let Biden forgive student debt, nor allow his administration to use their expertise to set rules. No way they’d let Biden get away with actual law breaking.

I think the best thing Biden can do is to make court reform central to his campaign-and every Dem running for office should too. Only if they control Congress and WH will the nation retake control of the SCOTUS. Absent that, the coup will be complete.

Noah, do you think this could be construed as the Supreme Court hobbling their own ability to act as a check against the President, thereby making their decision unconstitutional itself, as the Supreme Court is meant as one of the checks of power?

The sentencing in the Bragg case will come up shortly. Every one says "Oh jail would create such unrest." But now, if he gets the full sentence on all counts, Biden just has to send out the army to quell that unrest. Even apart from the use of "emergency powers." Oh, the Extremes will say, that is against the law. Oops--they've just deprived the courts of the power to say that.

I can easily see trump sending out the army to stop PEACEFUL protests, constitution be damned. At the very least the stupid opinion should have carved out a place specifically for a court to STOP unconstitutional actions or even just illegal actions. "Oh" they will say, "we just meant immunity from prosecution." But why does a president with absolutely no accountability for his actions have to pay any attention to what the courts say about, say, sending the DOJ to shut down the NYT when it says something he doesn't like? Prior restraint? Yeah, unconstitutional but I have the power to do it anyway and so I will. So sue me.
